Time Warner Willing to Cede Control of User Interface in Potential Deals for Apple TV Products

Two weeks ago, Bloomberg reported on Apple's struggles to reach television content deals that would enable the company to broaden its living room reach by providing set-top boxes to blend live and recorded material. The report noted that cable companies have generally been reluctant to work with Apple as they seek to retain control over the software and other aspects of their businesses, with Time Warner Cable said to be the major cable company most receptive to Apple's proposals.

The Hollywood Reporter now notes (via TechCrunch) that Time Warner Cable Chief Operating Officer Rob Marcus acknowledged at an investor conference today that his company would be willing to cede control over the user interface in scenarios such as those being rumored for Apple's proposals, as long as it can retain the existing customer relationship. The comments by Marcus appear to specifically address integration of the cable company's guide information with Apple's mobile devices, but could obviously extend to other products such as set-top boxes. Time Warner Cable is "hard at work at a cloud-based [TV] guide experience" and is open to giving up control of the user interface as it looks to make its service accessible via new devices, including Apple's iPhones and iPads, president and COO Rob Marcus told an investor conference in New York on Wednesday.

But he emphasized that this does not mean that the cable giant is willing "to give up the customer relationship" as the company is committed to ensuring that people know its TV services are provided by TW Cable and not any device maker or other third party.

Apple is rumored to have been working on a television product for quite some time as it continues to toy with the current Apple TV set-top box, which the company has repeatedly referred to as a "hobby" that it will continue to pursue as it assesses whether there is a larger opportunity in the market.

Rumors of an Apple television set have largely given way to talk of a new set-top box in recent months, a device that would bring Apple's hardware and software expertise to the consumer cable industry in an effort to meld live television with recorded and on-demand content while integrating into Apple's existing ecosystem. But with both cable companies and content providers being reluctant to strike deals with Apple, progress has been slower than many had hoped for.

Apple 'Unlikely' to Use Audience's New Noise Suppression Technology in iPhone 5

Audience today announced that it appears "unlikely" Apple will use the company's earSmart noise suppression technology in the upcoming iPhone 5. Audience's technology was reported to a key innovation providing support for Siri on the iPhone 4S, and Apple was reported back in February to have licensed Audience's next-generation technology for future products. But with today's announcement, it appears that Apple has elected not to take advantage of the technology. Audience sells processors and licenses its processor IP to Apple Inc. and certain of its subsidiaries (collectively, OEM) for inclusion in the OEM's mobile phones pursuant to a Master Development and Supply Agreement (MDSA). Pursuant to a statement of work under the MDSA, amended in March 2012, Audience developed and licensed a new generation of processor IP for use in the OEM's devices. However, the OEM is not obligated to use Audience's processor IP.

Audience now believes that it is unlikely that the OEM will enable Audience's processor IP in its next generation mobile phone. Audience is not aware of any intended changes by this OEM to its use of Audience's processors or processor IP in prior generations of the OEM's mobile phones.

Apple's decision not to use Audience's new IP in the iPhone 5 will impact Audience's financial picture beginning one quarter after the introduction of the iPhone 5, as Audience receives licensing royalties from Apple one quarter after the device's are sold to end users. Peter Santos, president and chief executive officer, commented, "While we are disappointed by this development, we are confident in the diversification of our business and see sustainable growth in 2012 and beyond. As such we are raising guidance for the third quarter of 2012. Looking ahead, we believe our expansion into adjacent markets such as Smart TVs, automotive, and notebooks, will continue to bring growth in 2013 and beyond."

Audience delivered a standalone voice processing chip for the iPhone 4, but the company's technology was reportedly incorporated directly into the A5 chip used to power the iPhone 4S. The improved Audience technology integrated into the A5 was said to be much better at suppressing background noise, thus allowing Siri to more easily pick out the user's voice.

It is unclear what voice processing technology Apple will be using in the iPhone 5, but it seems that the company has found a better or more cost-effective solution than that offered by Audience.

Update: Audience's stock is down over 40% in after-hours trading following the announcement.

Apple Working on Pandora-Like Music Service? [Updated]

According to a report from The Wall Street Journal, Apple is "seeking to create a Pandora-rival custom radio service." Citing "people familiar with the matter", the Journal claims the service would work across Apple's line of products -- including Macs, the iPhone and the iPad -- and possibly even on Windows PC's. Unsurprisingly, it would not work on Android devices.

Apple only recently initiated licensing negotiations with record labels for its putative service, and even if it does complete deals, it could be a matter of months when such a service might launch, according to these people.

The company has in the past contemplated and abandoned other interactive features, including a Spotify-like service that would have let users rent unlimited amounts of music for a fixed monthly fee. But people familiar with the current talks say they appear to be more serious than those previous tentative inquiries.

As on Pandora, the music would be interspersed with ads, in this case carried by Apple's iAd platform, which syndicates ads to iPhone and iPad apps.

The WSJ says Apple is negotiating its own licensing deals with record companies, rather than going by the government-set rates paid by Pandora.

The article does not lay out a timeline for the service, though its claim that Apple is still in negotiations with record companies suggests it won't be arriving at the Apple Media Event already announced for September 12.

Update 8:04 PM: The New York Times has filed its own report on the developments, citing "three people briefed on Apple’s plans". The report offers a similar description of Apple's goals, noting that the service would likely arrive as an app that could interface with a user's iTunes Store account to build upon the current Genius functionality in iTunes. Apple’s service would likely take the form of a pre-installed app on Apple’s devices like iPhones and iPads and might be able to connect to a user’s iTunes account to judge his or her tastes.

Like The Wall Street Journal, The New York Times indicates that a launch for the service "could be months away" and is not likely to be announced at next week's media event.

The newest comScore data should have Google, Samsung and LG (?) fans happy. According to the latest marketing numbers from the company, Google's Android still leads in the following category: Top Smartphone Platforms 3; Month Avg. Ending Jul. 2012 vs. 3 Month Avg. Ending Apr. 2012; Total U.S. Smartphone Subscribers Ages 13+. Android took up 52.2% of the market, which was an increase of 1.4%. Apple's iOS came in second with 33.4%, which was an increase of 2%. These numbers came at the expense of RIM, Microsoft and Symbian.

The most interesting thing about the study was the OEM numbers for the following category: Top Mobile OEMs 3; Month Avg. Ending Jul. 2012 vs. 3 Month Avg. Ending Apr. 2012; Total U.S. Mobile Subscribers (Smartphone & Non-Smartphone) Ages 13+. Samsung took first place (unsurprisingly) with 25.6%, which was a tiny decline of -0.3%. What was surprising is that LG is still in second place and Apple is still in third. LG held 18.4%, which was a decline of -0.8%, and Apple showed 16.3%, which was an increase of 1.9%. This dip was at the expense of Motorola which dropped -1.3% to an 11.2% marketshare.

Wow, even though they gained a few points, that's gotta sting for Apple to be second fiddle to LG. I wonder why they haven't sued them yet? For more info, hit the source link below.

The Apple vs. Samsung case... it's like a bad wreck that you don't really want to see, but you can't tear yourself away from. You rubberneck just to see what new gruesome body part is visible, and when you do, you are disgusted all over again.

That's exactly what we have here today. Apparently, the jury foreman, Velvin Hogan, on the Apple vs. Samsung case has been opening his mouth again, and jamming his foot further down his throat. He was strangely willing to sit down for an online interview with Gizmodo, and here are just a couple of bits of swill that spilled out of his mouth.

Demon-Xanth: Did you have the opportunity to ask ?Is this something that should be patentable?? during the trial?

Velvin Hogan: @Demon-Xanth ? No, however it was not the function of this jury to ask that. We were bound to use the law as it is today. The patents were issued the judge instructed us not to second guess the current patent system.

Guess what though? Determining whether something was patentable was precisely one of the duties that the jury was responsible for, and was expected of them. It makes you wonder if any of them even bothered to read the jury instructions.

Here's an exchange where Mr. Hogan was questioned about prior art. His response was nonsensical, and he was called out on it.

Wanhang: Why did you choose to ignore prior art despite it being a legitimate claim?

Velvin Hogan: @Wanhang ? I is not ignore prior art yes it was legitimate, however it was not interchangeable therefore it did not invalidate Apples patents?.Under the current law the prior art must be among other things interchangeable. the prior art sighted even Samsung does not currently use. Read the law and the statues covering Prior art.

Firewheels: @Velvin Hogan ? You?re suggesting, then, that the patent is on the particular implementation, not the overall concept? In that case, isn?t it clear that in many of the patents no infringement is possible, as clearly an implementation in Java (Android) is distinct from an implementation in Objective-C (iOS)?

If, however, you?re suggesting the patent is on the concept, then clearly there IS prior art, and therefore the patents are invalid. Either way, Samsung should not have been charged the exorbitant punitive damages you clearly believed were due.

When it comes to criminal lawsuits, a jury trial makes perfect sense. When it comes to patent lawsuits, it makes no sense whatsoever. In many ways, I feel sorry for Mr. Hogan and the jury. These folks were expected to determine one of the most important cases in the history of tech, and they don't really understand patent law or technology properly. We really need experts determining the outcome of trials like this one. Experts in patent law, and experts in technology. Ah well, even though his statements are likely inadmissible, perhaps the appellate judges will figure this stuff out on their own, and set things right for Samsung in the long run.

Sidenote: Oh, and btw... just to give you guys a heads up. Now that Apple is emboldened by their success, they will be amending their ban-request lawsuit to include the Samsung Galaxy S III and the OG Galaxy Note as well. ~ MobileBloom

WOW!!! This has taken so many twists and turns. I can't wait to see what happens in appeals. I hope the Apple doesn't get the expansion. I'm changing jobs next week and get to pick between either an iPhone or Android for my work phone and really wanted either a Note or an S3.

Is it out?! I thought it hadn't been released yet.Nothing official yet but possibly late September or October depending on non-US/US release dates. Not sure about the US but it should be by the end of the month for non-US. Not sure how long you can wait. Of course the Note is sold out from some vendors and if Apple gets the injunction waiting may not be a choice.

Apple's iPhone 5 is rumored for a Sept.21 release date, and the Internet has not stopped buzzing about potential features, alleged leaks and speculation. It is nearly certain that the upcoming iPhone 5 will support 4G LTE connectivity, but there is now more evidence to back up this claim.

Apple has reportedly been negotiating with two mobile carriers in Korea to provide the iPhone 5 through their LTE networks, according to CNET. Officials from SK Telecom and KT allegedly revealed this information to the Korea Times.

"KT is in negotiation with Apple to persuade the latter to support KT's 1.8 gigahertz frequency in Korea for the upcoming iPhone," a senior KT executive said to Korea Times. A KT spokesperson declined to comment.

Both of these carriers are authorized Apple partners selling the iPhone in Korea, and these companies want Apple to utilize their LTE networks; however, supporting 4G LTE is more of a challenge than working with a 3G network since different LTE networks around the world use their own frequencies, as CNET acknowledges.

In the United States, both Verizon and AT&T use 700MHz frequency, and AT&T also uses 2.1GHz. The Korean carriers SK and KT use different frequencies, which could push Apple to launch iPhone models with separate LTE modems to support varying frequencies. This is why the Korean variant of Apple's newest iPad doesn't come with LTE support.

But that doesn't mean LTE service isn't rapidly growing in Korea. At the end of July, the number of Korean LTE subscribers hit the 8.4 million mark and is expected to double that number by the end of 2012, The Korea Times reported. SK reached four million subscribers last month, only 44 days after it had achieved the three million milestone.

This could add pressure to Apple to produce iPhone 5 models that are compatible with LTE, leaving the Cupertino, Calif.-based company with the decision of whether or not it will be worth the cost and effort.

"If Apple's upcoming iPhone again fails to support LTE bandwidths, then this would be a very disappointing scenario as LTE is everywhere in Korea," an executive from SK Telecom told The Korea Times.

                                                  Preparing For The Masses

Apple clearly plans to gear up for mass production of its upcoming products, as its main supplier Foxconn Technology Group has invested up to $10 billion in labor in Indonesia. This would allow the Apple supplier to tap into one of the cheapest labor forces in Asia, as Reuters reported on Wednesday.

Foxconn has faced issues of labor unrest and rising wages in its main factories in China, and has attempted to diversify its production in different Asian markets.

"Foxconn already has factories in China and Brazil, and not yet one in Southeast Asia," Ali Soebroto Oentayo, chairman of Indonesia's electronics association, told Reuters. "I think Indonesia is a right decision from a market perspective."

The Taiwan-based company plans to begin building a plant in October in an industrial zone near Jakarta to assemble three million handsets a year, Reuters reported. Foxconn then plans to increase output later on, Indonesia's Trade Minister Gita Wirjawan said to the news wire service on Tuesday. The investment would be between $5 billion and $10 billion.

Foxconn sparked controversy in recent years for producing iPad and iPhones in factory conditions in China dubbed as sweatshops, resulting in worker deaths and suicides. Apple and Foxconn have since then pledged to improve working conditions for its 1.2 million employees in the country, and raise wages by 16 to 25 percent.

Apple is expected to unveil its next generation iPhone 5 alongside an iPad Mini on Sept. 12, with an alleged release date coming on Sept. 21. The company has yet to officially confirm this, but the rumor originated on Apple news blog iMore who cited "sources who have proven accurate in the past." On Tuesday, iMore also reported that Apple will start taking pre-orders for the iPhone 5 on the same day as the announcement.

The possibility of 4G LTE connectivity seems increasingly likely as CNET has reported, and on Tuesday an Apple patent delved into the mechanics of how Apple plans to create a thinner, sleeker "in cell" display. But what else may appear on the iPhone 5? Below is a list of alleged functions that are expected, although some are unconfirmed by Apple.

These indications come from discovered patents and words of Apple executives during conference calls and statements that have been reported on.
